Surrendering an Environmental Permit for a landfill or deposit for recovery site in England is the final regulatory step in the lifecycle of an operation where waste has been permanently deposited to land. It marks the point at which the Environment Agency (EA) is satisfied that the operation no longer poses a significant risk of pollution and that regulatory control can be relinquished. But surrender is not simply a formality or a tick box at the end of a site’s life; it is a risk-based, evidence-led process that should be considered from the day the permit is issued and throughout the life of the site from that point.
The first stage towards surrendering a permit is closure. When moving a site from the initial stage of closure to the aftercare period, operators must demonstrate full compliance with their environmental permit and meet the conditions set out in that permit before submitting a closure report to the EA for approval. Once the EA agrees the site is definitely closed, the landfill stops accepting waste, and the permit is varied to reflect its closed status, including updated monitoring and reporting requirements.
During the subsequent aftercare, the operator continues to manage, maintain and monitor the landfill in accordance with the approved closure report and permit conditions to ensure it does not cause pollution (this includes maintaining the cap and containment systems, conducting inspections and continuing environmental monitoring until the site meets the criteria for eventual permit surrender. The duration of aftercare varies according to site sensitivity, engineering and waste types.
There is currently no closure process or aftercare permit for a deposit for recovery activity.
Successful surrender applications are built on a robust system of recordkeeping, consistent monitoring, due diligence, and planning. Operators must undertake a surrender risk assessment, which is effectively a detailed conceptual site model. This assessment draws on operational and aftercare monitoring data and must demonstrate that the risks are either eliminated or reduced to acceptable levels using passive control measures rather than active ones. Active controls (such as pumping leachate or extracting gas) that require ongoing intervention cannot remain if surrender is to be accepted.
The EA sets clear completion criteria for key areas:
- Landfill gas: Demonstrating that methane/carbon dioxide concentrations and flow rates have reduced to low and stable levels.
- Leachate: Evidence that leachate quality and volume no longer pose an unacceptable pollution risk.
- Settlement and stability: Confirmation that waste has settled and slopes are stable. Unstable landforms will prevent surrender (for obvious reasons!).
A surrender application must include a surrender report that collates the evidence demonstrating the site meets surrender conditions. For parts of the site that were never used for deposition, a surrender site condition report is required. Plans showing the extent of the surrender area, monitoring results, risk assessments and documentation of any agreed changes to permit conditions are central to a successful submission.
The EA will ultimately approve a permit surrender only when it is confident that the site will no longer cause pollution, that any remaining controls will continue to function, and you have returned the site to a satisfactory state. This risk-based approach isn’t always straightforward to achieve, but with early consideration and ongoing awareness throughout the life of the site, it is far simpler to demonstrate regulatory compliance when it comes to surrender.
